In practice, this can influence site selection, infrastructure corridors, construction sequencing, and access arrangements before designs are fixed. Under this approach, engagement aligns with Indigenous governance structures, allowing Elders, knowledge custodians, Land Councils, or Prescribed Bodies Corporate to define appropriate decision making processes. Project options are developed collaboratively, timeframes reflect cultural responsibilities and community priorities, and Indigenous Knowledge is treated as a governed intellectual system. Within this context, FPIC functions as a structured process for progressing decisions with shared clarity rather than as a late-stage approval step. An essential but often underdeveloped dimension of transformational partnership is the recognition and protection of Indigenous intellectual property rights and Indigenous data sovereignty. As engagement moves upstream into project definition and option development, increasing volumes of Indigenous Knowledge, cultural information, spatial data, and governance insights are shared to inform design decisions. These knowledge systems are not public domain inputs; they are collectively held intellectual property governed by Indigenous law, authority, and cultural protocol. Transformational engagement therefore requires explicit agreement on how Indigenous Knowledge is accessed, interpreted, stored, and applied within project systems. Within this context, Free, Prior, and Informed Consent extends beyond consent for land access or physical works to include consent for the collection, use, visualisation, and retention of Indigenous data. This includes cultural narratives, spatial information, and digitally represented knowledge generated through engagement processes. Frameworks such as Indigenous data sovereignty principles emphasise Indigenous control over decision‑making relating to their data, including secondary use and long‑term custody. When these considerations are addressed early and transparently, Indigenous participation is strengthened as an exercise of governance rather than information provision, supporting clearer authority, trust, and accountability. These governance considerations become particularly material where digital tools are used to support engagement and co‑design.
